The Website is owned and operated by Flying Fish Research Ltd ("we" or "us") registered in the United Kingdom under company number 09957647 and have our registered office at 86-90 at C/O OXFORD INNOVATION LIMITED BUXTON COURT, 3 WEST WAY, OXFORD, UNITED KINGDOM, OX2 0JB. We are not VAT registered.
Accessing the Website
Access to the Website is permitted on a temporary basis, and we may withdraw or amend the services we provide on the Website without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period.
We may restrict access to some parts of the Website to users who have registered with us. In particular, access to our platform for participation in research studies is available only to registered members.
Our website integrates third party social media platforms. This means that if you subscribe to the services provided third party social media platform operators (for instance, Facebook, Inc.) you can use those services as integrated into our website. Your use of those services (and any related use of your personal information) will be governed by the applicable terms and conditions of the relevant platform operator.
Registration as a Participant
The service we offer via the Website (the "Service") consists of the provision of a platform on which you may participate in online research studies ("Studies") in return for payment. In these Website Terms of Service the completion by you of a Study is called a "Submission" and the sums to be allocated and paid to you in return for a successful Submission are called the "Reward".
To register to use the Service you must enter your first and second name, email address, and choose a password. Alternatively, we may from time to time enable the Website to allow registration using an existing social media account. You will then be asked to provide further personal information for the purposes of pre-screening to ensure that you participate only in those Studies for which you are suitable and qualify. Pre-screening information may include demographic information such as your age, ethnicity and nationality (although these are non-limited examples). Certain studies may only be available to users who meet the demographic profile required by those studies or who meet other eligibility requirements based on responses to pre-screening questions. Other studies may or may not be made available depending on your historical use of the Service - for instance, if you have a history of failing to complete studies in accordance with their requirements then this may disqualify you from participation in certain other studies.
We may from time to time request that you provide further information or documentation to verify your pre-screening information, and you may not be able to participate in certain Studies unless we have verified your pre-screening information to our satisfaction. If we have reason to believe that any information provided to us is false then we reserve the right to suspend or terminate your account with immediate effect.
If you know or suspect that anyone other than you knows your password or has made any use of your account, you must promptly notify us at email@example.com.
Studies and Submissions
Studies will be listed on the Website from time to time. You may, before participating in a Study, be required to agree to such additional terms and conditions as may apply to that Study.
It is your responsibility to ensure that your Submission is of reasonable quality and meets the specific requirements of the Study. You accept that if your Submission does not meet the requirements of the Study, or is determined by us in our discretion not to be of reasonable quality, you may not be paid any Reward or may be paid only a partial Reward.
All intellectual property rights in any Submissions will be owned by us, and you hereby assign and agree to assign all such intellectual property rights to us.
We will process and disburse all Rewards in connection with the Service in accordance with the terms outlined below. The Reward to which you are entitled for taking part in any Study will be listed at the same time as the Study.
After you complete a Study, you will need to wait until your Submission is approved before receiving the relevant Reward. If the Submission does not meet our standards, we may reject the Submission and no Reward shall be rendered to you. Approval (or rejection) of Submissions will usually be within 24-48 hours of your completion of the Study.
If your Submission is approved, we will apply the Reward to your account on the Website within seven working days of such approval. You may request payment of accumulated Rewards from time to time, provided that you have accumulated at least £5.00 at the time of request.
Payment of Rewards to you shall be made through our payment processing service provider PayPal, Inc. (to your PayPal account). The collection and processing by PayPal of your credit or debit card details and other personal data are governed by PayPal's terms and conditions. See https://www.paypal.com/uk/webapps/mpp/ua/privacy-full for more information. We do not obtain or process your credit or debit card details, nor any details of your PayPal account.
Rewards shall be paid in GBP Sterling and shall be inclusive of VAT unless stated otherwise.
We reserve the right to withhold or delay the payment of any Reward, at our sole discretion without any liability on our part:
a) in circumstances beyond our control (including, but not limited to, natural disasters, failures of telecommunications networks, power failure, data loss and the acts of any government) which prevent the proper execution of the transaction;
b) if we are unable to confirm your identity or have reason to believe that the transfer requested is unauthorised;
c) if we believe that you are in violation of these Website Terms of Service; or
d) if any dispute exists involving your nominated account or Submission.
If your account has remained inactive (i.e. you have not taken part in any Studies) for a period of twelve months, then we may close your account and dispose of any unclaimed Rewards on your account by either paying them to the PayPal account linked to your account (if the accumulated Rewards exceed £5.00) or retaining them ourselves (if the accumulated Rewards total less than £5.00 or if the PayPal account linked to your account is no longer open or able to receive funds).
Nothing in these Terms of Service shall give rise to a relationship of employer and employee between you and us. Please note that all Rewards earned through your use of the Service may constitute income for which you have personal tax liabilities which may be notifiable to the Inland Revenue. You warrant and undertake that you will pay any applicable taxes on all income derived from Rewards.
Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in the Website, and in the material published on it, including the Studies. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.
Breach, Termination and Suspension
You may at any time elect to stop using the Service. Please contact us at firstname.lastname@example.org if you wish to close your account. If you wish to close your account, it is your responsibility to ensure that any accumulated Reward is paid to you before closure.
Without limiting our other rights and remedies, we reserve the right to terminate or suspend your access to the Website and/or Service immediately and without notice to you if:
a) you are in breach of any term or condition of these Terms of Service (repeatedly or otherwise);
b) you are impersonating any other person or entity;
c) when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity; or
d) we suspect you have engaged, or are about to engage, or have in anyway been involved, in fraudulent or illegal activity in relation to the Service.
Liability and Indemnity
Nothing in these Website Terms of Service will affect or limit your statutory rights (including your rights as a consumer) or will exclude or limit our liability for any matter for which it would be unlawful for us to exclude or attempt to exclude our liability.
Subject to the above:
a) a) all warranties, representations, conditions and all other terms of any kind whatsoever implied by statute or common law are, to the fullest extent permitted by applicable law, excluded from these Website Terms of Service; and b) access to the Website and the Service is provided on an "as is" basis.
i) loss of profits, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or
ii) special, indirect or consequential loss; and
a) our total aggregate liability to you under or in relation to these Website Terms of Service or their subject matter (whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise) shall not in any event exceed £50 (fifty UK pounds sterling).
